TERMS OF USE, RETURN AND SERVICES TO THE ASSOCIATION
1- General Terms:
This website belongs to the Brazilian Association of Family and Community Nursing. These Terms set out the terms and conditions under which you may use our website and services offered by us. This website offers Association visitors direct benefits for members throughout Brazil, targeting:
- Nurses (professionals with a higher education certificate corresponding to the category);
- Nursing Technicians (professionals with a mid-level certificate for the category);
- Nursing Students (individuals in the training process, provided that the Enrollment Certificate is duly presented);
Members receive the benefit of using all the full resources based here, from subscribing to discussion groups with the availability of a public profile to visitors, having their profile photo and comments made available to members through the community tab (and may at any time make your private profile, losing the right to services offered in the community tab), annual fee control through the financial system based here, registration for courses and events, the use of resources in the library tab, as well as the dissemination of other information.
By accessing or using our service website, you acknowledge that you have read, understood and agree to be bound by these Terms.
2- Conditions of use and Services:
To use our website and/or receive our services, you must be at least 18 years of age or the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to participate in these services. You are not permitted to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
When purchasing an item or subscription relating to the category in which it falls, you agree that:
(i) you are responsible for reading the complete listing for the item/category before committing to purchase it, having full responsibility for keeping the information contained here up to date:
(ii) you accept a legally binding contract to purchase an item/category when you commit to purchase an item/category and you complete the checkout payment process.
The prices we charge for our services/products are listed on the website. We reserve the right to change our prices for displayed products at any time and to correct pricing errors that may inadvertently occur. Additional pricing and sales tax information is available on the payments page.
“The fee for the services and any other charges you may incur in connection with the use of the service, such as taxes and possible transaction fees, will be charged annually to your payment method, or monthly according to the event offered by the Association."
3- Exchange, Return and Refund Policy:
For any service offered on this website, simply express your interest in a return by contacting the email: comunicacao@abefaco.org.br, citing the reason for dissatisfaction and/or withdrawal along with a copy of the payment page, or value document ideally within 1 month of purchasing the service, and we will exchange or offer a refund based on the original payment method. Additionally, note the following:
(i) Services may be returned upon request by the account holder or person responsible for payment;
(ii) For any needs, please contact us at comunicacao@abefaco.org.br.
We may, without prior notice, change the services; fail to provide the Services or any features of the Services we offer; or create limits for services. We may permanently or temporarily terminate or suspend access to the Services without prior notice and liability for any reason or no reason.
Upon receipt of a valid warranty claim for a product purchased from our website or service, we will repair the relevant defect or replace the product or service. If we are unable to return or replace the product or service within a reasonable time, the customer will be entitled to a full refund upon prompt return of the product to us. We will pay for shipping repaired or replaced products to you and you will be responsible for returning the product to us.
We may permanently or temporarily terminate or suspend your access to the Service without prior notice and liability for any reason whatsoever, including if, in our sole and exclusive determination, you violate any provision of these Terms or any applicable law or regulation. You may discontinue use and request cancellation of your account and/or any service at any time. Notwithstanding anything to the contrary with regard to automatically renewed subscriptions to paid services, such subscriptions will be discontinued only after the end of the corresponding period for which you have already made payment.
You agree to indemnify and hold harmless Associação Brasileira de Enfermagem de Família e Comunidade from any demands, losses, liabilities, claims or expenses (including attorneys' fees), made against them by any third party due to, or arising out of, or in connection with the use of the website or any of the services offered on the website.
To the maximum extent permitted by applicable law, under no circumstances will Associação Brasileira de Enfermagem de Família e Comunidade be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including, without limitation, damages for lost profits, goodwill, use of data or other intangible losses, arising out of or in connection with the use of or inability to use the service.
To the maximum extent permitted by applicable law, the Associação Brasileira de Enfermagem de Família e Comunidade assumes no responsibility for any errors (i), errors or inaccuracies of content; (ii) personal injury or property damage, of any nature, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we change the Terms in a material way, we will notify you. Your continued use of the Site or our service after any changes constitutes your acceptance of the new Terms. If you do not agree with any of these terms or any future version of the Terms, do not use or access (or continue to access) the Site or the Service.
4- Image and maildelivery services:
The Service and all materials contained or downloaded therein, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Rights to Intellectual property related to them is the exclusive property of the Brazilian Association of Family and Community Nursing. Except as explicitly provided herein, nothing in these Terms shall be deemed to constitute a license in or under such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, perform publicly, publish, adapt, edit or create derivative works.
You agree to receive promotional messages and materials from time to time by post, email or any other contact form you may provide to us (including your telephone number for calling or texting). If you do not wish to receive these promotional materials or notices - please simply notify us at any time.
5- Dispute resolution and customer support:
These Terms, the rights and remedies provided herein, and any and all claims and disputes related thereto and/or the Services, shall be governed, construed and enforced in all respects solely and exclusively in accordance with the internal laws of Brazil, without respect to its conflicting legal principles. Any and all claims and disputes will be brought, and you consent to them being decided exclusively by a court of competent jurisdiction located in Rio de Janeiro. The application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded.
